Injury claims work differently in Northern Ireland

Northern Ireland did not adopt the fixed whiplash tariff and online portal that England and Wales introduced in 2021. Here, injury claims are still assessed on their individual facts through the traditional route — medical evidence, negotiation and, if needed, the courts — which generally means they're valued more fully than a fixed tariff allows.

That also means the at-fault insurer's first phone call offering to 'settle the injury quickly' is one to be wary of. Early offers are usually made before the full picture of your recovery is known. Talk to us before you accept anything.

Any injury claim stands on its medical evidence. See your GP or a physiotherapist, describe your symptoms honestly and keep a note of how the injury affects work, sleep and daily life. A medical report from an appropriate expert is what ultimately underpins the value of the claim.

How long do I have to make an injury claim in Northern Ireland?

Generally three years from the date of the accident for personal injury, though it's much better to start early while evidence and memories are fresh. Different limits can apply for children or specific circumstances, so check with us or a solicitor promptly.

Will I have to go to court?

Usually not. Most injury claims settle by negotiation once the medical evidence is in. Court is the backstop for when an insurer won't offer a fair figure — and having solid evidence and representation is exactly what avoids it.

Can I claim for whiplash if the damage to my car was minor?

Yes. Injury and vehicle damage are assessed separately — genuine soft-tissue injuries happen in low-speed impacts, and a minor dent doesn't disprove them. What matters is prompt medical evidence, not the size of the repair bill.
